ARTICLE 1 – Scope of application

These General Terms and Conditions of Sale (the “GTCS”) apply, without restriction or reservation, to all sales made by SARL FELMANN BIS (Ô P’tit Repère Du Goût)

, registered with the Dijon Trade and Companies Register under number 529592768 and having its registered office at 8 Rue des Vieilles Carrières, 21410 Fleurey-sur-Ouche (also referred to as “the Vendor”) to non-professional buyers (“Customers”) wishing to purchase the products offered for sale on the website https://www.optitreperedugout.fr/ (“The Site”).

The purpose of the Site is :

• Marketing of food products and beverages (alcoholic and non-alcoholic),
• Disseminating information about the company’s activities,
• Access to a virtual space allowing customers to exchange information with the Company.

The essential characteristics of the products are detailed on the Site. The customer acknowledges having read them before placing an order.
Product offers are valid while stocks last.
Acceptance of these General Terms and Conditions of Sale is mandatory for any order placed on the Site.

ARTICLE 2 – Prices

Prices are expressed in Euros and include VAT. They are firm and non-revisable during their period of validity, but the Vendor reserves the right to modify them outside this period.

The prices displayed do not include the costs of processing, shipping, transport and delivery, which are invoiced in addition.
An invoice is drawn up and given to the Customer upon delivery.

ARTICLE 3 – Orders

The customer selects the products of his choice on the Site, adds them to his basket, then validates his order after accepting the GTCS. The order becomes final once payment has been confirmed.

The Vendor reserves the right to cancel any order in the event of a previous unresolved dispute.
Customers can track the progress of their order from their personal space on the Site.

ARTICLE 4 – Terms of payment

Payment is due at the time of order, by credit card via a secure payment system.
The Vendor will only deliver the products once payment has been received.

ARTICLE 5 – Deliveries

Deliveries are made within 7 days in mainland France. In the event of a delay of more than 30 days, the customer may request cancellation of the order.

The customer must check the condition of the products on receipt and report any anomaly within 48 hours.

ARTICLE 6 – Right of withdrawal

Customers have 14 days to exercise their right of withdrawal. Products must be returned in perfect condition. The customer is responsible for return shipping costs.

ARTICLE 7 – General Terms and Conditions for the Use of Gift Certificates

1. Validity and use
   This gift voucher is valid for one year from the date of purchase. It is expressly agreed that this voucher cannot be extended or reimbursed, even in the event of non-use during the validity period. Ô P’tit Repère du Goût will not be held liable for any reimbursement, change or exchange of any kind whatsoever. Furthermore, the voucher may not be used on public holidays.

2. Amount greater than the gift voucher
   If the total amount of consumption exceeds the value of the gift voucher, the beneficiary must pay the difference by any means of payment accepted by Ô P’tit Repère du Goût.

3. Partial use of the gift voucher
   In the event of partial use of the gift voucher, no refund or exchange will be made for the unused portion. The remaining balance must be used before the end of the gift voucher’s validity period.

4. Fraud and counterfeiting
   Any fraudulent use of the gift voucher or any attempt to counterfeit it may result in legal action.

5. Changes to conditions
   Ô P’tit Repère du Goût reserves the right to modify these terms and conditions of use at any time without notice. The applicable conditions are those in force at the date of purchase of the gift voucher. The beneficiary of the gift voucher is invited to regularly consult these conditions in order to take note of any possible modification.

ARTICLE 8 – Personal data

The Vendor collects personal data in order to manage orders and deliveries. This data will not be passed on to third parties for advertising purposes.
Customers may exercise their right to consult, modify or delete their data by contacting the Vendor.

ARTICLE 9 – Intellectual property

The content of the Site is protected by intellectual property law. Reproduction in whole or in part is prohibited.

ARTICLE 10 – Applicable law and disputes

These GCS are governed by French law. In the event of a dispute, the Customer may have recourse to a mediator or refer the matter to the competent courts.
